These Terms of Use ("Terms") govern your use of HaulMargin, a freight load profitability calculator operated by NiONlite LLC ("NiONlite", "we", "us", or "our") on iOS, iPadOS, the Apple App Store, or TestFlight. By downloading, accessing, or using HaulMargin, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old to use HaulMargin. If you are under the age of majority where you live, you represent that you have permission from a parent or legal guardian to use the App.
2. License
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use HaulMargin on supported Apple devices that you own or control, solely for personal or internal business use.
You may not copy, modify, reverse engineer, sell, lease, sublicense, scrape, abuse, overload, or interfere with the App, its services, its security systems, or third-party services used by the App.
3. What HaulMargin Does
HaulMargin helps users estimate freight load profitability by entering load details, offered pay, route information, miles, tolls, diesel price, MPG, maintenance cost, fixed cost, driver pay, dispatch fee, factoring percentage, and target profit. The App may estimate route miles using Apple map and location services when available.
Important: HaulMargin is a planning and estimation tool. It is not accounting, tax, legal, financial, insurance, safety, brokerage, carrier compliance, dispatch, or business advice. You are responsible for verifying all load details, costs, payments, contracts, lanes, tolls, routes, regulations, and business decisions.
4. Estimates and User Responsibility
- Profit calculations depend on the numbers you enter and the assumptions you choose.
- Route mileage estimates may differ from actual truck routes, traffic, detours, legal restrictions, toll roads, weather, construction, and dispatch instructions.
- Toll automation is not guaranteed unless and until a supported truck toll provider is integrated and available in your region.
- Fuel prices, MPG, maintenance costs, fixed costs, driver pay, dispatch fees, factoring fees, accessorials, detention, layover, and broker/customer payments can vary.
- You are solely responsible for accepting, rejecting, pricing, or negotiating any freight load.
5. Free and Pro Features
HaulMargin may offer a free version for basic use and a Pro subscription for additional features such as saving new load estimates, reopening named loads, higher limits, or other tools. Free users may be able to access previously saved loads already stored on the device. Feature availability may change over time.
6. Subscriptions, Trials, and Payments
HaulMargin Pro subscriptions are purchased through Apple's in-app purchase system and billed to your Apple ID. Subscription options may include monthly and annual plans. Prices, taxes, free trial eligibility, introductory offers, and availability may vary by country, region, and App Store rules.
- Payment is charged to your Apple ID at confirmation of purchase, except where an eligible free trial or introductory offer applies.
- Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period.
- You can manage or cancel Apple subscriptions in your Apple ID subscription settings.
- Cancellation stops future renewal but usually allows access through the remainder of the current paid billing period unless Apple or applicable law provides otherwise.
- Refund requests for Apple purchases are handled by Apple at reportaproblem.apple.com.
7. User Content and Saved Estimates
You are responsible for load names, addresses, lane details, cost assumptions, notes, and other content you enter into the App. You agree not to submit unlawful, abusive, misleading, infringing, or harmful content.
You retain ownership of your content. You grant NiONlite the limited right to process content as needed to provide App features, support, security, and troubleshooting.
8. Privacy
Your use of HaulMargin is also governed by the HaulMargin Privacy Policy, which explains how information is collected, used, stored, and shared.
9. Third-Party Services
HaulMargin depends on services from Apple, including App Store, TestFlight, StoreKit, current location permission, Core Location, MapKit, geocoding, directions, diagnostics, and crash reporting. We are not responsible for outages, limitations, pricing changes, policy changes, or errors caused by third-party services.
10. App Availability and Changes
We may update, modify, limit, suspend, discontinue, or remove features at any time. We do not guarantee that the App, route estimation, subscription services, or third-party services will be available, uninterrupted, secure, accurate, or error-free.
11. Intellectual Property
HaulMargin, including its design, software, branding, text, graphics, icons, and other content, is owned by NiONlite LLC or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership of the App or any NiONlite intellectual property to you.
12. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIONLITE LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOST PROFITS, MISSED LOADS, LOAD LOSSES, BUSINESS INTERRUPTION, ROUTING ERRORS, FUEL OR TOLL DIFFERENCES, OR RELIANCE ON ESTIMATES. OUR TOTAL LIABILITY FOR CLAIMS RELATED TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR HAULMARGIN PRO IN THE 12 MONTHS BEFORE THE CLAIM OR $50.
14. Indemnification
You agree to defend, indemnify, and hold harmless NiONlite LLC from claims, losses, liabilities, damages, costs, and expenses arising from your use of the App, your content, your load decisions, your violation of these Terms, or your violation of law or third-party rights.
15. Apple App Store Terms
If you downloaded HaulMargin from the Apple App Store or use it through TestFlight, these Terms are between you and NiONlite, not Apple. Apple is not responsible for the App or its content, maintenance, support, warranty, or claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as related to your App Store use.
16. Governing Law
These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict of law rules. This does not limit any consumer rights you may have under the laws where you live.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and may provide notice in the App or on our website. Continued use of the App after changes take effect means you accept the updated Terms.
